When you get into an accident, the insurance company has to compensate you for your incurred damages. But, most insurance company delays the case in the hope of paying less than the amount you deserve. Most insurance companies look out for their profits. Unfortunately, they deny or postpone your claim more than they should because they focus more on money.

By understanding the tactics most insurance companies use, you can identify what will happen and work with your Atlanta Personal Injury Lawyer to discuss your settlement.

What to do when an insurance Adjuster Delays your Personal Injury Claim?

If your insurance company delays your personal injury claim, you can fight back. Here’s what you can do if your insurance company stalls your claim.

1. Writing a Formal Letter.

Writing a formal letter is a way to show the insurance company that you are serious regarding the personal injury claim. A demand letter is a document that states what you believe is an appropriate settlement based on your compensation evaluation. You can also note that you may bring the case to court if you do not receive the proper settlements you deserve.

2. Escalate

If your insurance adjuster disagrees with the settlement you deserve, tell them that you want to speak to their supervisor. If they refuse to connect you with any higher authority, find an available phone number of the insurance company and try again. The chances of receiving a fair settlement become higher when more people look at the case.

3. Persistence

Stay in contact with your insurance company. Make frequent calls or send emails and ask about the progress of your settlement. For example, if they mention that a higher authority is reviewing your case, ask them when you will receive an update.

4. Mention bad Faith

Your insurance company has signed up a contract with you. The agreement clearly shows that the insurance company must pay quickly and honestly when a claim falls under their policy. If you can prove to the jury that the insurance company did not legally work with you to pay your claims, the court may find the insurance company acting in bad faith. In that case, the company has to owe you legal fees, including your claim’s value.

5. Hire an Attorney and Bring a Lawsuit

Hiring an experienced lawyer will help you negotiate with the company on your behalf if you face delay tactics. They are experts in their field and can create a plan to contact the insurance company. You do not have to worry about what to say because your attorney will handle all negotiations directly.
